TalentRise respects intellectual property rights and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. ยง 512, we have adopted the following policy regarding copyright infringement on our Platform.
1. Reporting Copyright Infringement
If you believe that content on TalentRise infringes upon a copyright that you own or are authorised to act on behalf of, please submit a written DMCA Takedown Notice to our Designated Copyright Agent.

2. Required Elements of a DMCA Takedown Notice
Pursuant to 17 U.S.C. ยง 512(c)(3), your written notice must include all of the following:
- Physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
- Identification of the copyrighted work โ describe the work you believe has been infringed (e.g., “My original song titled ‘Song Name’ recorded in [year]”). If multiple works are covered by a single notice, a representative list is acceptable.
- Identification of the infringing material โ provide the exact URL(s) on TalentRise where the allegedly infringing content is located.
- Your contact information โ full legal name, mailing address, telephone number, and email address.
- Good faith statement โ “I have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.”
- Accuracy statement โ “I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.”
3. Our Response to Valid Notices
Upon receipt of a valid, complete DMCA Takedown Notice, we will:
- Promptly remove or disable access to the allegedly infringing content.
- Notify the user who submitted the content that it has been removed.
- Provide the user with a copy of the DMCA notice (with your personal information redacted where reasonably possible).
4. Counter-Notice Procedure
If content you uploaded was removed due to a DMCA notice and you believe the removal was made in error or you have the right to use the content, you may submit a Counter-Notice to our Copyright Agent.
Your Counter-Notice Must Include:
- Your physical or electronic signature.
- Identification of the content that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification.
- Your name, address, telephone number, email address, and a statement that you consent to jurisdiction of the Federal Court for the judicial district in which your address is located.
Upon receiving a valid Counter-Notice, we will forward it to the original complainant and may restore the content within 10โ14 business days unless the complainant files a legal action.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, TalentRise has adopted a policy of terminating the accounts of users who are deemed repeat infringers. An account may be terminated after receiving two or more valid DMCA notices, or at our sole discretion for particularly egregious single violations.
6. Fair Use Notice
We acknowledge that not all uses of copyrighted material are infringing. Fair use, commentary, criticism, parody, education, and other uses may be legally protected. Before submitting a takedown notice, please consider whether the use may constitute fair use under applicable copyright law.
7. Trademark Complaints
For trademark complaints, please contact us at support@skitmanna.com with the subject line “Trademark Complaint.” The DMCA process does not apply to trademark disputes.
